Bonding and partner care are separate questions
Federal FMLA recognizes several parent-child relationships, including qualifying in loco parentis relationships, where someone assumes parental responsibilities. Marriage is not a universal prerequisite for a parent to seek bonding leave for their own child.
Caregiving leave for an adult partner can work differently because the applicable law may define spouse, domestic partner, or family member in a particular way. State programs and employer policies may include relationships beyond federal FMLA. Ask about the exact program and reason.
Request the documentation standard
Ask what establishes the parent relationship or placement and whether alternative documentation is accepted. A birth certificate, adoption or placement record, or statement of parental responsibility may be relevant depending on the program.
Provide what is required without assuming you must submit every private family document. If the administrator asks for something that does not fit your situation, ask which rule requires it and how the program handles the relationship you have described.
Use a neutral clarification
I am requesting bonding leave as the child’s parent. Please identify the relationship definition and documentation requirements under this benefit. Our family structure does not match the labels on the standard form, so I would appreciate instructions for completing it accurately.
That keeps the conversation centered on eligibility and administration. If you encounter inconsistent treatment or discrimination concerns, document the response and seek review through the appropriate process.
Plan each parent’s leave independently
Each parent should verify employer coverage, work history, pay, and remaining leave. If both work for the same employer, ask whether any combined limit applies and to whom. Do not assume a rule written for spouses applies identically to every household, or that it never applies to yours.
